Welcome to Old Town Ink. These Terms & Conditions (“Terms”) govern your use of the Old Town Ink website, including oldtownink.com, as well as appointment requests, consultations, tattoo services, purchases, and other interactions with Old Town Ink (“Old Town Ink,” “we,” “us,” or “our”).

By using our website, submitting an appointment request, booking an appointment, paying a deposit, or receiving services from Old Town Ink, you agree to these Terms.

1. Tattoo Appointments & Consultations

Submitting an appointment request through our website, email, social media, or another communication method does not guarantee an appointment.

Appointments are confirmed only after the selected artist or Old Town Ink has accepted the request and, when applicable, any required deposit has been received.

Appointment availability, scheduling, pricing, consultation requirements, deposits, and other booking policies may vary by artist.

Old Town Ink and its artists reserve the right to decline any tattoo request or discontinue a consultation or appointment when reasonably necessary.

2. Deposits

A deposit may be required to reserve an appointment or begin work on a custom design.

Deposit amounts, refundability, transferability, rescheduling requirements, and cancellation policies may vary by artist and will be communicated at or before booking.

Unless otherwise stated by the artist, deposits are applied toward the final cost of the tattoo.

Failure to comply with the cancellation or rescheduling policy provided at booking may result in the loss of a deposit and may require a new deposit before another appointment can be scheduled.

3. Cancellations, Rescheduling & No-Shows

If you need to cancel or reschedule an appointment, please contact your artist as soon as possible.

Individual artists may establish their own minimum notice requirements for cancellations or rescheduling.

Late cancellations, repeated rescheduling, significant lateness, or failure to appear for a scheduled appointment may result in forfeiture of a deposit, cancellation of the appointment, or a requirement to submit a new deposit before rebooking.

If an artist must cancel or reschedule an appointment, reasonable efforts will be made to arrange another appointment.

4. Late Arrivals

Please arrive on time and prepared for your appointment.

Late arrival may reduce the amount of tattooing that can be completed during your scheduled session or may require the appointment to be rescheduled.

Old Town Ink cannot guarantee that an artist will be able to extend an appointment because a client arrives late.

5. Age & Identification Requirements

Clients must provide valid government-issued photo identification when requested.

Anyone under eighteen (18) years of age may only receive tattoo services when permitted under applicable Arizona law and Old Town Ink's current shop policies.

When services for a minor are permitted, the minor's parent or legal guardian may be required to be physically present and provide satisfactory identification and documentation establishing the relationship or guardianship.

Old Town Ink may establish age requirements that are more restrictive than those required by law and may decline to tattoo a minor at its discretion.

6. Client Responsibility & Health

Tattooing involves puncturing the skin and carries inherent risks.

Before receiving tattoo services, clients are responsible for informing their artist of any condition, medication, allergy, skin condition, illness, or other circumstance that could reasonably affect the tattooing process, healing, or the client's safety.

Clients should consult an appropriate healthcare professional if they have questions about whether receiving a tattoo is medically appropriate for them.

Old Town Ink and its artists do not provide medical advice.

We reserve the right to refuse or postpone service when an artist reasonably believes tattooing should not proceed for health, safety, sanitary, or professional reasons.

7. Alcohol, Drugs & Impairment

Clients may not receive tattoo services while intoxicated or materially impaired by alcohol, recreational drugs, or other substances.

An artist may refuse or discontinue service if the artist believes a client is impaired or unable to provide informed consent.

8. Tattoo Risks & Healing

By choosing to receive a tattoo, you acknowledge that tattooing involves inherent risks, which may include:

  • Pain, discomfort, swelling, redness, bruising, bleeding, or scabbing;

  • Allergic or other reactions to inks, pigments, adhesives, bandages, or aftercare products;

  • Infection;

  • Scarring or changes in skin texture;

  • Changes in tattoo appearance during healing;

  • Fading or changes caused by aging, sun exposure, skin characteristics, lifestyle, or other factors; and

  • Individual healing responses that cannot always be predicted or controlled.

No tattoo artist can guarantee exactly how a person's skin will accept pigment or how a tattoo will heal.

Nothing in these Terms is intended to waive any right or liability that cannot legally be waived under applicable law.

9. Aftercare

Clients are responsible for following the aftercare instructions provided by their tattoo artist.

Improper aftercare, excessive sun exposure, swimming, scratching, picking, failure to keep the tattoo appropriately clean, use of unsuitable products, or other actions during healing may negatively affect the tattoo.

Contact your artist if you have questions regarding tattoo aftercare. Contact an appropriate healthcare professional if you believe you are experiencing a medical problem or infection.

10. Touch-Ups

Touch-up policies may vary by artist and tattoo.

Whether a touch-up is complimentary or requires an additional charge may depend on the artist's policy, the amount of time that has passed, how the tattoo healed, the location of the tattoo, and whether proper aftercare instructions were followed.

Complimentary touch-ups, when offered, do not generally cover damage or fading caused by improper aftercare, injury, excessive sun exposure, changes to the skin, or other circumstances outside the artist's control.

Contact your artist directly regarding touch-up eligibility.

11. Tattoo Designs & Artistic Interpretation

Reference images submitted to Old Town Ink are used to communicate ideas, styles, placement, composition, or other preferences.

Unless specifically agreed otherwise, reference images do not guarantee an exact reproduction.

Artists may modify a concept based on tattooability, placement, body anatomy, longevity, artistic considerations, originality, or professional judgment.

You will have an opportunity to review the proposed tattoo design, placement, and sizing before tattooing begins.

It is your responsibility to review spelling, dates, numbers, symbols, placement, orientation, and other important design details before approving the tattoo.

Once you approve the design and tattooing begins, changes may not be possible without additional work or expense.

12. Custom Artwork & Intellectual Property

Original artwork created by an Old Town Ink artist remains the intellectual property of its respective creator unless otherwise agreed in writing.

Payment for a tattoo does not automatically transfer copyright or reproduction rights to the underlying artwork.

You may photograph and display your completed tattoo for personal purposes.

Artwork, photographs, logos, graphics, text, videos, and other materials appearing on the Old Town Ink website or social media accounts may not be copied, reproduced, sold, commercially exploited, or used to falsely represent another artist's work without permission from the applicable rights holder.

13. Photography & Social Media

Artists may ask to photograph or record completed tattoos for portfolios, websites, social media, advertising, or other promotional purposes.

Where consent is required, Old Town Ink or the artist will obtain that consent before using identifiable photographs or recordings.

You may tell your artist if you do not wish to have your tattoo photographed or shared.

14. Pricing

Tattoo pricing varies based on factors that may include artist, size, placement, complexity, style, detail, color, design preparation, and the amount of time required.

Quotes and estimates are not guaranteed unless expressly stated to be a fixed price.

For work billed by time, the final cost may differ from an initial estimate depending on the amount of time required to complete the tattoo.

Payment is due as instructed by the artist or shop.

15. Refusal of Service

Old Town Ink and its artists reserve the right to refuse service when reasonably necessary, including because of:

  • Intoxication or impairment;

  • Threatening, abusive, discriminatory, or inappropriate behavior;

  • Health or safety concerns;

  • Unsanitary conditions;

  • Requests involving artwork an artist is unwilling or unable to perform;

  • Failure to provide required identification or consent;

  • Failure to comply with shop policies; or

  • Other legitimate professional or safety concerns.

Harassment, threats, violence, or abusive behavior toward artists, staff, clients, or guests will not be tolerated.

16. Website Appointment Requests

Information submitted through our website is considered an inquiry unless and until an appointment is confirmed by the applicable artist or Old Town Ink.

Submitting a form does not guarantee artist availability, acceptance of a project, pricing, or a specific appointment date.

Please make sure the email address, phone number, artist selection, and other information you provide are accurate so that we can respond to your request.

17. Website Content

We make reasonable efforts to keep information on our website accurate and current. However, artist availability, pricing, hours, policies, portfolio information, services, and other information may change.

Website content is provided for general informational purposes and should not be considered medical, legal, or other professional advice.

18. Third-Party Services & Links

Our website may contain links to Instagram, payment processors, scheduling platforms, maps, social media platforms, or other third-party websites and services.

Old Town Ink does not control these third-party services and is not responsible for their content, availability, privacy practices, security, or terms.

Your use of third-party services is subject to the policies and terms established by those providers.

19. Communications

When you contact Old Town Ink or one of our artists, you authorize us to respond using the contact information you provide.

Submitting an appointment or contact form does not, by itself, require you to consent to unrelated marketing communications as a condition of receiving tattoo services.

You are responsible for ensuring the contact information you provide is accurate.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Old Town Ink will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or circumstances outside Old Town Ink's reasonable control.

Tattoo services involve individualized artistic work and individual biological healing responses. Old Town Ink does not guarantee that every tattoo will heal, age, fade, or appear identically on every person.

Nothing in these Terms limits liability where limiting liability would be prohibited by applicable law.

21. Privacy

Information collected through our website, appointment forms, or other communications is handled in accordance with our Privacy Policy and applicable law.

Please review the Old Town Ink Privacy Policy for additional information regarding how personal information is collected, used, and protected.

22. Changes to These Terms

Old Town Ink may update these Terms periodically to reflect changes to our services, policies, website, or applicable legal requirements.

The current version will be posted on our website with an updated effective date.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

23. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Any dispute arising from these Terms or use of the Old Town Ink website will be subject to the jurisdiction of courts having proper jurisdiction in Maricopa County, Arizona, unless applicable law requires otherwise.

24. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
